This Privacy Policy applies to the information we collect through the websites our company owns [collectively, the “Site”]; online services that we make available; when you apply to rent at one of our properties; when you access our property’s AppFolio Resident Portal website or related mobile applications that may be available for download; through other off-line interactions [on-site property visits]; and through other general inquiries we receive [including postal mail, electronic mail, telephone requests, and in person].

Purpose

The purpose of this Privacy Policy is to inform you about the types of personal information we gather about you, including personal information gathered when you visit the Site, and personal information we may receive from third parties or affiliates in addition to that online information, how and why we may use that information, whether we disclose that information and who we may disclose that information too, and the choices you have regarding our use of, and your ability to correct, the information. This Policy does not cover information that is exempted from privacy policy notification requirements. If you do not agree to the terms of this Privacy Policy, you are not authorized to use the site.

Individuals who reside in California and have provided their Personal Information to us may exercise their rights under the California Consumer Privacy Act (“CCPA”). Personal Information We Collect

Personal Information we collect may include: your name, email addresses, postal addresses, postal codes, social security/individual tax payer identification number, passport number, driver’s license number, prior addresses, monthly rent paid at prior residences, employers, job titles, income, telephone numbers, credit card information, utility account information, renters insurance information, bank account information and routing numbers, date of birth, gender, age, marital status, emergency contact information, information about your pets/animals, information about your vehicles including license plate numbers, and other information necessary for the purpose of managing and renting residential premises and to provide quality services to our consumers. We may also collect information about you such as your use of the Site and communication preferences.


We do not and will not sell your Personal Information.


How and Where We Collect Your Personal Information

We may collect information in several ways: by your use of this Site, as well as forms you submit to us, personal communication such as email, text, calls, or letters you send to us, information you include in an application you submit on the Site, information you provide when scheduling a property tour through the Site, or any other activity through which you identify yourself to us. Although you may decline to voluntarily provide Personal Information when asked, some features, products and services will be unavailable to you as a result. 


We also may collect Personal Information through the following:

  • Online Services: We collect Personal Information when you interact with our Online services which may include, but are not limited to, searching for an apartment, applying to rent an apartment, communicating with us, posting to social media pages, or participating in a survey.
  • Property Visits and Offline Interactions: We collect your Personal Information when you visit our properties, and/or inquire about housing directly with our properties.
  • Other Sites and Third Parties: We may use separate sites for the processing of applications and agreements and to assist our residents and service providers with other tasks which are required or helpful to them, such as paying rent online. We may also receive information about you from third parties. For example, if you are on another website and you opt-in to receive information from us, that website will forward us your email address and other information about you so that we may contact you as requested and in accordance with applicable law.
  • Other Sources: We collect Personal Information from other sources, such as public databases or credit agencies. Where legally required, we will obtain your consent before collecting or processing your Personal Information. 
  • Information that we observe: We might collect and save information about, among other things, your preferences in type of rental housing and communication method preference. 
  • Mobile: If you use an app created by a third-party with whom we have a relationship, they may collect and save information about your location and your mobile device. This information may be used for a variety of purposes, including providing you with location-based services, advertising, search results, rentals, and other personalized content. Most mobile devices allow you to turn off location services.


Why We Collect and Use Personal Information

Our company collects personal information primarily for the purpose of managing and renting residential premises. The information that we learn from and about you helps us personalize and improve your experience and improve the rentals, products, and services that we (or a third-party with whom we have a relationship) provide you. 


We use the information that you provide for purposes of: 

  • Engaging with prospective residents. 
  • Processing rental applications and communicating with applicants about their rental application. 
  • Performing credit checks, background checks, or other screenings necessary for processing rental applications under our screening policy criteria.
  • Managing residential premises, such as responding to your requests and inquiries; providing maintenance or other on-site services; and communicating with you. 
  • Providing requested services, including, without limitation, enabling you to use the Resident Portal. 
  • Sending targeted messages, publication, news and information about events, special offers, promotions and benefits. 
  • Conducting surveys about consumer experiences. 
  • We use the information you provide for the purposes of: Security and legal obligation by means of detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activities. 


How and When we Share Personal Information

Third Parties with whom we have a relationship: We work closely with third-party vendors to provide you rentals, products, and services that are important to your experience with the Property. To provide those rentals, products, and services, those third parties have access to personal information. These third parties may use your personal information to deliver relevant services and consistent with their legal, regulatory and other obligations. 


Business Transitions: If the Property goes through a business transition, such as a merger, acquisition, or sale, your personal information will be part of the assets transferred. By using the website and providing your personal information, you consent to this transfer.


Protection of the Property and others: We share account and other personal information when we believe sharing is appropriate to comply with the law; enforce or apply our terms of use and other terms and agreements; protect the rights, property, or safety of the Property, our users, or others. For example, the Property may share information (a) with other companies and organizations for fraud protection and credit risk reduction; (b) to help the Property defend against claims and/or exercise a legal right or remedy that the Property may have; or (c) to respond to lawful requests by public authorities.

Cookies make it easier for us to provide rentals, products, and services that are tailored to you. We use cookies to, among other things, understand and save user’s preferences for future visits, keep track of advertisements, assess the technical function of our website, and compile aggregate data about site traffic and site interactions to offer better site experiences.


Our website may use cookies which allow us or third parties to advertise our rentals, goods, or services on websites that you access after you have visited our website. You may also see advertisements from us if other websites that you visit, such as google.com, use cookies to capture that you have been on our website. 


This Site uses Google Analytics (and in the future may use other similar sites or services), a web analytics service provided by Google, Inc. (“Google”), to better assist Company in understanding how the Site is used. Google Analytics will place cookies on your computer that will generate information that we select about your use of the Site, including your computer’s IP address. That information will be transmitted to and stored by Google. The information will be used for the purpose of evaluating consumer use of the Site, compiling reports on Site activity for Company’s use, and providing other services relating to Site activity and usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Sometimes, those products or services are obtained from a third-party’s website, in which case, the third-party websites will have separate and independent privacy policies. We are not responsible for those third-party websites, the third party’s privacy policies, or the actions of those third parties.


Personal Information of Minors

Our Sites are not directed to minors under the age of 16 and we do not knowingly collect Personal Information from minors. We may collect Personal Information of minors, provided by parents or guardians, in connection with the application and rental of a unit, or the provision of property management services. We do not sell the Personal Information of minors. By using our website, you represent that you are not under 16 years of age. If you are a parent or guardian and you believe that your child under the age of 16 may have provided personal information through our website, please contact us by the means identified below. 


Security

We are committed to protecting the security of any personal information we collect. Appeals

If you disagree with a decision we have made with respect to your personal information or privacy right request you have submitted, you can appeal the decision by providing written notice to the contact information provided below* Your written request should be labeled "Notice of Appeal" and fully describe your concerns or disagreement and include any documentation necessary to validate the claims you are making. Following a review of your appeal, we will reach a determination of your appeal, which may include modifying or upholding the original decision. We will notify you of our determination in writing within sixty (60) days of receipt of your written notice of appeal, and we will include the explanation for our determination of your appeal.


California Consumer Privacy Notice (CCPA)

This privacy notice for California Residents supplements the information contained in the Hi-Valley Development Corporation Privacy Policy and applies solely to visitors, users and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.


Personal Information We Collect

We collect the following categories and specific pieces of Personal Information and may collect such items of information regarding California residents:

  • Identifiers: name, postal address, email address, contact information, internet protocol address, internet cookie identification number, social security number, taxpayer identification number, bank account/credit card number, driver’s license number, passport number, date of birth, picture, resident identification number, device identification number, emergency contact details.
  • Personal Information categories listed in California Civil Code § 1798.80(e): name, signature, social security number, address, telephone number, passport number, insurance policy number, education, employment, employment history, financial information.
  • Protected classification characteristics under California or federal law: age, race, color, ancestry, national origin, citizenship, marital status, sex, veteran, or military status.
  • Commercial Information: records of products or services purchased, obtained, or considered, other purchasing histories or tendencies, utility bills, insurance claimant name and contact information, credit history, lease information, rental history, rent amount.
  • Internet or other electronic network activity information: browsing history, search history, internet protocol address, cookie identification number, information regarding consumer’s interaction with a website, internet postings.
  • Employment or other professional information: current job and past job history, job title, pay history, and income.


We collect this information from you and other sources as described in the Hi-Valley Privacy Policy Notice. 


Use and Disclosure of Personal Information

We use information as described in the Why We Collect and Use Your Personal Information section of the Hi-Valley Development Corporation Privacy Policy Notice. We disclose certain Personal Information as described in the How and When we Share Personal Information section of the Hi-Valley Development Corporation Privacy Policy Notice.

Right to Opt-Out of the Sale of Personal Information

We use third party Cookies for advertising and website analytics which may be considered selling within the context of CCPA. Hi-Valley Development Corporation does not otherwise sell personal information as defined by the CCPA.


Right to request the deletion of personal information 

You have the right to request that we delete any of your Personal Information that we collected and retained that is covered by the CCPA. Once we receive and confirm your verifiable consumer request, we will delete your Personal Information from our records as permitted and consistent with applicable law.

We will not discriminate against a consumer for exercising any of their privacy rights under the CCPA by doing any of the following:

  • Your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or are your authorized representative.
  • Provide sufficient detail that allows us to properly understand, evaluate, and respond to your request. 
  • We will disclose and deliver the required information free of charge within 45 days of receipt of your verifiable request. 
  • The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.

Exercising your Oregon Consumer Privacy Act (OCPA)

You have the right to delete or request that we assist in deleting the Personal Data that we have collected about you. Please note, however, that we may need to retain certain information when we have a legal obligation or lawful basis to do so. You can use the contact information provided at the end of this privacy policy notice to submit your written request by Mail or Fax.


Once we receive and confirm your request, we will delete your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us to:
